Are Kei Trucks Legal in Virginia?

Virginia has no kei-specific law. What it has is a general import statute, and that statute is unusually explicit about the 25-year line. Subsection A of § 46.2-602 is the barrier: the Department "shall not issue a permanent certificate of title or registration for a foreign market vehicle until the applicant submits proof that the vehicle complies with federal safety requirements." Subsection E removes that barrier entirely for anything built 25 or more years ago, and subsection F confirms the outcome — a negotiable title, not the restricted nonnegotiable title that a younger non-compliant import receives.

In practice that means a 25-year-old Japanese kei truck is handled as an ordinary used vehicle being titled for the first time in Virginia. The documentary work is the normal import file — a foreign ownership document with a certified English translation, the US Customs entry summary, the USDOT HS-7, a bill of sale — plus Virginia's own title and registration application. The statutory obstacle that stops many imports simply does not apply.

Two caveats that the statute does not remove. Virginia runs an annual safety inspection, and a vehicle registered for highway use has to pass it; § 46.2-602 governs what proof of federal compliance the Department requires at titling, not what a state inspector looks for at the garage. And the exemption is measured from the date of manufacture, not the model year — a truck built late in a model year may be exempt months after an otherwise identical one.

We could not establish any Virginia Department of Motor Vehicles guidance that addresses kei vehicles by name, in either direction. We also searched the Code of Virginia for a definition of "mini-truck" and a prohibition on operating one, because several widely-copied summaries assert that Virginia bans mini-trucks from its highways; we found no such definition in § 46.2-100 and no such prohibition in § 46.2-915.1, the section those summaries usually cite, which in fact deals with all-terrain vehicles and off-road motorcycles. On the evidence we could source, Virginia's position on a 25-year-old kei truck is the position in § 46.2-602.

What you can do in Virginia

Title it as a foreign market vehicle 25 or more years old. Have the foreign ownership document and a certified English translation, the US Customs entry summary, the HS-7 showing the 25-year exemption, and the bill of sale, and apply for the Virginia certificate of title and registration in the ordinary way.

Budget for the safety inspection as part of the purchase, not as an afterthought. Lights, wipers, brakes, tyres, mirrors and a windscreen in acceptable condition are what will decide whether the truck is on the road next month, and a cheap import that fails on several of those is not cheap.

If the truck is less than 25 years old, stop. Under subsection A Virginia will not issue a permanent title or registration without proof of compliance with federal safety requirements, and the manufacture date, not the model year, is what counts.
